The court of Salerno has issued a historic ruling, condemning the Ruggi d'Aragona hospital company to pay 1 million euros in compensation to the family of a little girl who was seriously injured during a birth in 1999. The decision comes at the end of a long legal process that has revealed serious medical responsibilities.
According to what emerged in the courtroom, the birth was conducted in a forced manner despite the initial tests not having highlighted any particular critical issues. The inappropriate intervention caused an immediate arrest of the newborn's vital functions, who had to be urgently resuscitated and transferred to the neonatal intensive care unit.
The consequences were devastating: the child suffered intrapartum asphyxia which caused irreversible brain damage, leading to a diagnosis of spastic tetraparesis and moderate-severe mental retardation.
The court also rejected objections regarding the statute of limitations, ruling that the statute of limitations begins to run from the moment the injured party or his family members become fully aware of the nature and causes of the injuries suffered. After 25 years, the family finally gets justice for a case that has profoundly affected their lives.
