Four prominent members of the Casella-Minichini clan have been released from prison by the investigating judge of the Naples court, Marcello De Chiara, who accepted the request to declare the pre-trial detention order against them ineffective.

They are Giuseppe Righetto, Luigi Aulisio, his son Nicola Aulisio and Domenico Gianniello.

The move has reportedly led to a review of the situation for the defendants, aligning with recent decisions by local magistrates in similar cases, with significant implications for justice.

The defense, highlighting the so-called "chain of charges," argued and demonstrated that the investigation elements were already in the prosecutor's possession when the first major ordinance for mafia association was issued, which on November 19, 2022, severely hit the De Luca Bossa-Minichini-Casella clan.

However, the District Anti-Mafia Directorate (DDA) would have requested and obtained, two years later, the issuing of a further restrictive measure.

The defense team emphasized that the terms of precautionary custody relating to the second measure should have been backdated to the date of the first order. Once the limit of twelve months was exceeded, the preliminary investigations judge De Chiara declared the ineffectiveness of the measure, executed only a few months ago.

The issue is particularly relevant in the fight against racketeering affecting the Cercola and Ponticelli areas.

The decision by investigating judge De Chiara represents a new chapter in the legal battle for those involved and marks a turning point in the monitoring of criminal activity in the Naples area.
