Torre Annunziata, fraudulent bankruptcy at Cmo: assets worth 12 million euros seized

Torre Annunziata – Real estate and land with a total value of almost 12 million euros have been seized as part of an investigation into fraudulent bankruptcy.

The order, issued by the GIP of the Court of Torre Annunziata at the request of the Oplontina Prosecutor's Office, was executed by the Guardia di Finanza, with the involvement of the Economic-Financial Police Unit of Naples and the Torre Annunziata group.

The seized assets

In detail, 44 properties and 8 lands located between Torre Annunziata, Boscotrecase, Ercolano and Milan were blocked, for a total value of 11.716.185,94 euros.

The origins of the investigation

The investigation originates from the request for preventive composition presented in 2024 by the company CMO Srl, operating in the multi-specialist diagnostic medicine sector in Torre Annunziata.

The investigative investigations, conducted on the basis of the filed documentation and the reports of the judicial commissioners, would have highlighted operations harmful to the creditors, dating back to a corporate split that occurred in 2015.

The disputed split

According to what has been reconstructed by the investigators, the company CMO Srl would have transferred the entire real estate branch and some credits, for a total value of 14.750.685,94 euros, to the newly established company Gigante Immobiliare Srl, which would have had the same shareholder structure.

At the same time, liabilities for 10.855.849,13 euros would have been transferred. Furthermore, CMO Srl would have maintained the availability of the properties transferred through rental contracts, with rents deemed disproportionate and, in some cases, not even paid.

In light of these elements, the GIP ordered the preventive seizure of the real estate transferred during the split operation. The measure was motivated by the concrete risk that the availability of the assets by Gigante Immobiliare Srl could aggravate the consequences of the crime.

The connection with the preventive settlement

According to the Prosecutor's Office, the composition proposal approved on 31 December 2024 by the Court of Torre Annunziata, provided that the payment of the creditors of CMO Srl would derive largely from the sale of a portion of the assets deemed to be the object of diversion.

The operation marks an important step in the fight against economic crimes, underlining the need for protection of creditors and the fight against potentially fraudulent corporate maneuvers.
