Giffoni Valle Piana - The conviction for the murder of baker Ciro Palmieri, which occurred in the Salerno municipality in July 2022, is causing controversy.
The Salerno Assize Court has issued a first-instance sentence for the murder of baker Ciro Palmieri, sentencing his wife, Monica Milite, to 18 years in prison and his son, Massimiliano Palmieri, to 15 years.
Both were found guilty of murder, but their sentences were reduced from the statutory minimum (21 years) due to the recognition of mitigating circumstances, in particular that linked to anger caused by an unjust act by another, i.e. provocation.
The murder occurred in Giffoni Valle Piana and involved 30 stab wounds to the victim, whose body was then dismembered and thrown into black garbage bags. The Court recognized the existence of aggravating circumstances, related to the victim's family relationship, cruelty, and the presence of minors, but deemed the mitigating circumstances to prevail.
The sentences imposed are lower than those requested by the prosecutors, who had asked for 25 and 22 years of imprisonment respectively. Another son of the victim, a minor at the time of the events, had already been sentenced to 16 years by the investigating judge of the Juvenile Court.
The Court of Assizes, while not recognizing either self-defense or excessive negligence, allowed the mitigating circumstances to prevail over the contested aggravating circumstances.
