AVELLINO – The first hearing of the trial against Max Passariello, 39 years, of cervinara, accused of voluntary homicide aggravated by futile motives and cruelty towards Joseph Tirone, 51 years old, also from cervinara.
The hearing, chaired by Dr. Gian Piero Scarlato, took place in front of the Assize Court of the Court of Avellino. Passariello, defended by the lawyers Victor Fucci e Domenico Cioffi, is accused of killing Tirone after an argument. During the hearing, the evidence presented by the defense was admitted, including defense documentation which includes several complaints filed by Passariello, his wife and others against Tirone for harassment while intoxicated. In particular, photographic evidence was acquired documenting the damage caused by Tirone the night before the crime against the door of Passariello's house.
Subsequently, they were heard on Deputy Inspector Fantasy el 'Inspector Honey of the Police Station of cervinara, who had intervened at the crime scene. The two witnesses confirmed that they knew Passariello as a worker and revealed that they were aware of several complaints filed against Tirone, including by the victim's parents.
Finally, it was heard Michael Tirone, father of the victim and civil party in the trial. In court, he initially described his son as a good person, but, when asked by the lawyer Victor Fucci, admitted that he had reported his son in the past and that Tirone used to bother people when he was drunk.
According to the prosecution, after an argument with Tirone, Passariello would have sprinkled the victim with flammable liquid, setting it on fire. Tirone was transported to the hospital in serious condition. Cardarelli of Naples, died after ten days of atrocious suffering. Also present in the courtroom were PM Celia Annecchini and the lawyers of the civil parties Stincone, From Maria e Cecere. The Court adjourned the trial to the next hearing, which will be held on 24 March.
