Naples - The Court of Napoli, accepting the appeal supported by Federconsumatori Campania APS, declared the practice of ASL Napoli 1 Centro of suspending exempt healthcare services "due to disputes regarding alleged debts relating to the past, without the due procedure and investigation" to be illegitimate.

Since 2022, without any formal communication and without the necessary administrative verification, the ASL Napoli 1 Centro had unfairly denied her access to the free healthcare services to which she was entitled, demanding payment of old debts that had not been correctly assessed", states Federconsumatori Campania APS, which supported the case legally and had "long denounced this irregular and discriminatory practice adopted by several local health authorities in Campania".
"This is a historic victory," emphasizes Giovanni Berritto, president of Federconsumatori Campania APS, "because it has finally been established, clearly and unequivocally, that the constitutional right to health cannot be arbitrarily subordinated to the recovery of sums the health administration deems due, even without following legal procedures. This ruling reaffirms that health is a fundamental right, not a commodity, and cannot be used to unduly pressure the most vulnerable citizens."
