The Regional Administrative Court of Campania has overturned the order for the removal from office of the former commander of the Municipal Police of Pomigliano d'Arco (Naples), Luigi Maiello.
The ruling, accepting the appeal presented by Maiello, marks a turning point in the affair that last April had led to his removal from employment with the Municipality. The judges rejected the Authority's assessments, deeming them to lack solid legal basis.
According to the TAR, the Municipality did not have the authority to independently declare the forfeiture, based on an alleged invalidity of a series of managerial positions held by Maiello.
“Such assessments are not among those permitted to justify dismissal from employment,” reads the ruling, which criticizes the lack of a complete investigation and formal objections in the competent authorities.
The annulled provision dated back to April 2023, when Maiello had been reassigned to the “Citizen Services, Ceremonial and Employer” sector after the revocation, in January of the same year, of the position of commander of the municipal police decided by the mayor.
The mayor of Pomigliano d'Arco, having learned of the TAR's decision, declared: "We will evaluate the reasons for the sentence with the utmost attention. If we consider them to be well-founded, we will take note of them and comply. Otherwise, we are ready to appeal to the Council of State to defend the reasons of the Administration".
A position that leaves open the possibility of a further judicial chapter in the affair.
The TAR ruling temporarily restores Maiello to his status as a municipal employee, but the final word could now be up to the second-instance judges, in a case that continues to divide public opinion and put the administrative management of Pomigliano d'Arco under the spotlight.
