49-year-old from Airola acquitted of receiving stolen goods: judge accepts defense argument

BENEVENTO – He was accused of pocketing a stolen check for over 3 thousand euros, with the aggravating circumstance of falsifying the beneficiary, but the trial ended with a full acquittal. DM, 49 years old, resident in Airola, was acquitted by the Single Judge of the Court of Benevento, Dr. Rotili, who accepted the arguments presented by the lawyer Vittorio Fucci.

According to the reconstruction of the Prosecutor's Office, the check - issued by Banca Intesa Sanpaolo - had been stolen from a condominium that had never received it and then altered in the name of the beneficiary. DM, again according to the prosecution, had tried to profit from it by depositing it in his own account at Banca Popolare di Milano, a branch of Airola. A serious charge: receiving stolen goods, with a potential penalty of up to eight years in prison.

But the accusatory framework did not stand up to the scrutiny of the trial. The defense arguments of the lawyer Fucci in fact convinced the judge, who deemed the elements necessary for a conviction to be absent, ordering the acquittal of the accused. A sentence that closes the case, overturning the expectations of the prosecution, which in the courtroom had asked for the conviction.

It was a very complicated case and the verdict surprised everyone. I don't know if it was right or wrong, but in the end the judge decided to acquit him. Maybe there were errors in the evidence presented by the prosecution.
