The Court of Naples, Section IV, has issued a historic sentence in favor of the residents of Piazza San Domenico Maggiore, condemning the Municipality of Napoli for noise pollution related to nightlife.
The decision, which echoes previous rulings by the Tenth Section and other Italian courts, including the Court of Cassation, recognizes the violation of the fundamental rights to health, privacy and housing.
The Municipality will have to compensate 40.000 euros to each of the 19 citizens who are applicants and adopt concrete measures to protect health, the environment and liveability.
“This ruling is a warning to institutions, which are often absent in the management of the territory,” said Gennaro Esposito, president of the Vivibilità Cittadina committee. “The law gives municipalities control and planning powers to guarantee fundamental rights, as established by the Consolidated Law on Local Authorities and the Environmental Code.”
The committee dedicates the victory to the memory of Piero Calamandrei, founding father and defender of human rights, emphasizing that "the city is not a consumer good". The sentence represents a step forward in the protection of citizens against the excesses of movida and the distorted interpretation of the "right to entertainment".
