Rome - Francesco Emilio, MP for the Alliance of the Greens and the Left (AVS), Borrelli, presented an urgent question to the Ministers for Public Administration and the Interior, once again bringing to light the controversial administrative situation of the Municipality of Pomigliano d'Arco.
The parliamentary motion, filed yesterday, highlights the failure to implement a ruling by the Campania Regional Administrative Court (TAR) and the alleged unlawful management of the Local Police Force.
Borrelli, known for his attention to the criminal and administrative dynamics of the area, recalls having previously raised in Parliament the "serious and disconcerting allegations" of the Mayor of Pomigliano d'Arco, who has consistently denied the presence of organized crime, placing himself at odds with the parliamentary anti-mafia commission and the Naples prosecutor's office.
The questioner highlights how the Ministry of the Interior has ordered an inspection of the municipality to ascertain possible mafia infiltration, the official results of which are still awaited and could have "significant institutional implications."
At the heart of the question is the case of Municipal Police Commander Luigi Maiello. Borrelli reconstructs how Maiello, a key figure in sensitive investigations into organized crime, was investigating an alleged real estate deal worth tens of millions of euros linked to the implementation of the "housing plan."
In this context, among the companies that had obtained building permits deemed illegitimate by the judiciary, there would also be a company hit by an anti-mafia interdiction for links with the family of a person convicted of crimes aggravated by the mafia method.
The administration led by Mayor Russo had removed Commander Maiello with a forfeiture order, which was subsequently suspended and then definitively annulled by the Campania Regional Administrative Court with a "heavy merits ruling" (no. 2918 of April 8, 2025). The administrative court had highlighted the "clear unlawfulness" of the municipal act.
Despite the TAR's clear ruling, Borrelli emphasizes with "great concern" that to date no measures have been taken to reinstate Maiello to his duties.

Meanwhile, the position of Chief of the Local Police Force continues to be held "illegitimately and de facto" by Emiliano Nacar, a Marigliano Municipal official on leave. Nacar had been appointed on a fiduciary basis (pursuant to Article 110, paragraph 1, of Legislative Decree No. 267/2000) in August 2024 with a deed signed by the Deputy Mayor of Pomigliano d'Arco.
Borrelli also recalls that the City Council had awarded Nacar, in addition to his position salary, a personal allowance of €1.460,00 gross per month, linked to the "temporary nature of the employment relationship, which is also conditional on the termination of the assignment by operation of law in the event of a negative outcome to the pending legal proceedings."
According to the interpellation, the Campania Regional Administrative Court's ruling no. 2918/2025 would have resulted in the "automatic termination" of Nacar's fixed-term contract, thus eliminating the basis for the vacant management position.
Commander Maiello, through his lawyers, had formally requested his reinstatement with a formal notice of default filed on April 9, 2025, addressed to the Director of Sector 2 and the Secretary General. However, this communication has "still remained unanswered."
Borrelli highlights the risk that the actions taken by Emiliano Nacar, "who has been removed from office," are "potentially void or otherwise illegitimate," with potential "serious legal and financial repercussions for the municipal administration."
In light of these facts, the Honorable Borrelli asks the ministers being questioned whether they are aware of the situation described and whether they deem it necessary to "urgently initiate all investigations into the failure to comply with the TAR ruling and, where appropriate, the legitimacy of the actions adopted by the current leadership of the Pomigliano d'Arco local police."
Finally, it requests clarification on the initiatives the Ministers intend to adopt to "ensure compliance with judicial decisions and the protection of administrative legality in the local authority in question."

The interpellation of the deputy Borrelli seems to be very important for the situation in Pomigliano d'Arco. However, there are many things that are not clear and need to be clarified, such as the management of the Local Police and the sentences of the TAR.
