The Court of Avellino acquitted GR, a 29-year-old from San Martino Valle Caudina, accused of violating the precautionary measure of the ban on approaching his ex-wife in 2021.
The Single Judge, Dr. Eligiato, accepted the arguments of the lawyer Vittorio Fucci, recognizing the non-existence of the crime, aggravated by the recidivism within five years.
According to the prosecution, GR had visited his ex-spouse's home several times, violating the ban imposed for previous mistreatment in the family, a crime for which he had been sentenced in the first instance to 4 years of imprisonment.
The Court of Appeal, however, had already overturned that sentence, acquitting GR thanks to the defense of Fucci, who took over at the second level.
Today, the new acquittal also closes the related proceedings, confirming the lawyer's defense line and exonerating the 29-year-old from all charges.
