Benevento – No revocation of the suspended sentence. This was ruled by the Benevento Court, acting as execution judge, rejecting the request made by the Prosecutor's Office in a case involving a young man from San Salvatore Telesino , already known to law enforcement.
The decision was made following the hearing before Dr. Monaco, who fully accepted the defense's arguments put forward by attorney Massimo Viscusi, thus confirming the benefit of the suspended sentence associated with an eight-month sentence for evasion.
At the heart of the proceedings is a complex legal matter: after a motion to continue the offenses was filed, the Court had already reduced the overall sentence by three years, deeming the various incidents the defendant was accused of to be unified under a single criminal plan.
A sensational "discount" that has reshaped the young man's prison trajectory, initially destined to remain detained until December 2028 and now about to be released from prison in September 2025.
The prosecutor, however, had requested the revocation of the suspended sentence granted for the last sentence included in the continuation order. The Court deemed this request unfounded, noting that the defendant's criminal record contained no convictions handed down by the Court of Rome, a crucial factor for the suspension to hold.
The case dates back to September 2022, when the young man, under a restraining order, left without authorization to go to Tor Bella Monaca, Rome, where he was stopped and arrested. The charges at the time were possession of narcotics for the purpose of trafficking (a crime for which he was fully acquitted) and resisting arrest, for which he served a final sentence, reduced on appeal to eight months.
The man, a repeat offender, remains in prison for a number of years, but the Benevento Court's decision marks a turning point in his legal journey, significantly advancing his release date.
The Benevento Court's decision appears to be well-reasoned, but I question whether it's right to grant a suspension in cases like these. The issue of sentences must always be carefully considered to avoid setting precedents.
