Benevento, Annunziata Floriano acquitted on appeal

Annunziata Floriano, 35, a well-known figure in judicial circles and known as “'a Picchietella,” originally from Arpaia, in the Benevento area, was acquitted on appeal.

The Court of Appeal of Naples, fully accepting the defense arguments of lawyer Vittorio Fucci, overturned the first-instance sentence in which the woman had been convicted by the Court of Santa Maria Capua Vetere for the crime of escaping from house arrest.

With the decision of the Neapolitan judges, Floriano was acquitted of all charges, ending a proceeding that, according to the defense, was based on a partial reconstruction of the facts and on evidence insufficient to support a conviction.

The judicial affair

The alleged incident occurred during a period when Floriano was under house arrest. According to the prosecution, she left her home without authorization, thus constituting the crime of escape.

Attorney Fucci, however, argued that there was no clear evidence of a voluntary or malicious departure, highlighting inconsistencies in the testimonies and the findings of the checks carried out by law enforcement.

The Court of Appeal of Naples, accepting this line of defense, deemed the subjective element of the crime to be non-existent, ordering the woman's acquittal.

According to the prosecution, Floriano was allegedly part of a group linked to the Piscitelli clan, also known as the “Cervinari,” active between the provinces of Naples and Benevento.
The Naples District Anti-Mafia Directorate (DDA) has requested a 12-year prison sentence for her, but the defense has already presented its arguments in court, and the sentence is expected soon.

A controversial figure, 'a Picchietella is considered by investigators to be a link between the criminal circles of Arpaia and the Camorra networks in the Vesuvian area.
