Santa Maria Capua Vetere – The legal case involving Domenico Massimiliano Cerra, 32, a Guardia di Finanza officer and current commander of the Giulianova Company, has ended with a full acquittal.
The Court of Santa Maria Capua Vetere, fully accepting the defense arguments of lawyer Vittorio Fucci, acquitted the captain of the charge of ideological forgery of a public document committed by a public official in the exercise of his duties.
The origins of the process
The alleged events date back to 2018, when Cerra served as Commander of the Operations Section of the Caserta Company. According to the prosecution's allegations, the then-officer prepared a service report that did not fully correspond to the facts, regarding an incident involving a patrol from the unit he commanded.
On that occasion, a vice-brigadier on board the service car had fired two gunshots after having ordered a car to stop which, despite the service warning light, had forced the checkpoint running away.
According to the Prosecutor's Office, the official report drawn up by Captain Cerra contained omissions or inaccuracies regarding the circumstances surrounding the use of the service weapon.

The public prosecutor had requested a two-year prison sentence for the defendant, believing that the document had altered, even if only partially, the truth of the facts.
The defense and the sentence
The defense, represented by lawyer Vittorio Fucci, forcefully maintained the absolute absence of malice and the complete correctness of the officer's actions, emphasizing that the contested report faithfully reflected what happened and had been drafted in good faith immediately after the events.
The Court, sharing this position, issued a sentence of acquittal with the formula "because the fact does not exist", recognizing Cerra's complete extraneousness to any conduct of falsification or alteration of the documentary reality.
A verdict that restores serenity
The decision of the Court of Santa Maria Capua Vetere thus brings to an end a matter that had weighed on the career and reputation of the young officer for over five years.
Captain Cerra, who in the meantime continued his professional career in the Guardia di Finanza, is now set to progress through the ranks, shortly assuming the role of Major.
A ruling that, besides marking the end of a trial, also sends an important message: that of trust in justice and the integrity of the institutions called upon every day to uphold the law.

It's important that justice works as it should. The Cerra affair demonstrates that sometimes there are misunderstandings and that things don't always go as expected. I hope there won't be any more similar problems in the future.
