A new judicial development has emerged in the case involving Massimiliano Imbemba, a figure believed to be close to the so-called Verde clan. Following the complete annulment of his eight-year prison sentence for drug trafficking by the Court of Cassation (Fifth Criminal Section) on October 3, 2025, the Naples Court of Appeal (First Section) has ordered the defendant's release from prison.

The order follows a request from Imbemba's lawyers, Dario Vannetiello and Leopoldo Perone, who highlighted the fact that the maximum pre-trial detention terms had been exceeded.

The Neapolitan judges, agreeing with the defense's arguments, therefore ordered Imbemba's release, without applying any alternative or restrictive measures.

The decision follows the Supreme Court's remand and annulment of the convictions handed down at first and second instance, which had deemed a new trial necessary to verify the drug trafficking charges. Now, pending a new trial, Imbemba is free after a lengthy period of pretrial detention.

The case represents a new chapter in the legal proceedings surrounding the drug trafficking network linked to the Verde clan, a group active in the northern area of Naples and already at the center of several investigations by the District Anti-Mafia Directorate.
