The Court of Benevento, chaired by Judge Rotili, acquitted RMD, a 30-year-old from Montesarchio, of the charge of mistreatment and injury against his then-pregnant partner, ordering his release and the revocation of all precautionary measures still in force.
The panel thus supported the defense line supported by lawyer Vittorio Fucci, in stark contrast to the request of the public prosecutor, who had called for a four-year prison sentence.
The man was arrested in flagrante delicto by Carabinieri officers from the Montesarchio branch following an intervention triggered by a tip-off from the woman's brother. According to the documents, the brother was alerted by his sister's text message about the alleged ongoing violence and alerted law enforcement.
According to the prosecution's case, the 30-year-old allegedly subjected his partner to a series of habitually violent and harassing behaviors, culminating in the incident that led to his arrest. During that incident, the woman was found to have injuries to one eye and several abrasions on other parts of her body, circumstances that further aggravated the initial evidence against the defendant.

After being arrested in flagrante delicto, RMD was first taken to prison, then released and placed under house arrest. During the proceedings, the precautionary measure was further mitigated by replacing house arrest with a ban on approaching the victim, enforced with the aid of an electronic bracelet.
Subsequently, however, the 30-year-old allegedly violated the restraining order against his ex-partner, a circumstance that prompted the judge to further tighten the precautionary regime, imposing – in addition to the electronic bracelet – a ban on him from residing in the Municipality of Montesarchio.
With today's ruling, the Benevento Court acquitted RMD, simultaneously revoking both the ban on approaching the victim with an electronic bracelet and the ban on residing in Montesarchio, resulting in the defendant's full release.
The decision, which fully embraces the arguments of attorney Fucci, brings to a close—at least in the first instance—a legal case that, since the arrest in flagrante delicto, had attracted considerable local attention due to the seriousness of the charges and the particular condition of the alleged victim, who was pregnant at the time of the events.

The Benevento court's ruling seems a bit strange to me, especially since there were several charges against RMD and his partner was pregnant. I don't know if it's right to acquit him like this without considering the evidence.
