After two years, the case that had shaken the community of Ariano Irpino has come to a close. With an order dated October 27, 2025, the Judge for Preliminary Investigations of the Court of Benevento dismissed the criminal proceedings against Pina Scaperrotta and Luigi Trancuccio, owners of the Oasi pizzeria, assisted by attorney Guerino Gazzella.
The investigation was opened in the fall of 2023, following the death of Gerardina Corsano, 46, from Flumeri, who died at Frangipane Hospital in Ariano Irpino a few days after dining there with her husband, Angelo Meninno. Both had suffered severe spasms and were rushed to the hospital: he later recovered, but she did not.
Initially, investigators suspected a case of botulism food poisoning, perhaps linked to a homemade chili pepper oil served at the table. The incident sparked widespread alarm and outrage, sending the pizzeria into a wave of suspicion.
Investigations: No toxins in the food
After more than twelve months of investigations, analyses, and technical consultations ordered by the judicial authorities, a very different truth emerged: Corsano's death was caused by phosphine poisoning, a chemical used in agriculture to disinfect grains and in no way related to the food products served in the restaurant.
The expert reports categorically ruled out the presence of toxic substances or traces of botulism in the seized foods and ingredients.

"The judge's decision confirms what we've been saying since the beginning of the case," commented attorney Gazzella, emphasizing that his clients have always operated "in compliance with health and hygiene regulations and with a great sense of responsibility towards their customers."
"After two years of pain and unfounded suspicions, the truth has finally been revealed," he added. "This order restores dignity to two honest people, unjustly implicated in a tragedy that was not their fault."

The pizzeria's owners were emotional. "There are no winners or losers, only the truth," said Luigi Trancuccio, thanking everyone who has shown their trust and support during these difficult years.
Pina Scaperrotta and Trancuccio expressed their gratitude to the Ariano community for their support and announced their intention to continue the work with the same commitment and passion as always.
While pleased with the legal outcome, the two restaurateurs wished to extend their condolences and respect to the Corsano family: "We remember Gerardina with deep sorrow, and we remain close to her loved ones in the face of such a painful loss."
