Naples - A full, albeit technical, acquittal was handed down by the Sixth Criminal Section of the Court of Naples, Dr. Daniele, at the conclusion of a long and detailed trial. MR, 56, originally from Benevento, was cleared of the serious charges of resisting a public official, assault, and refusing to provide information about his personal identity.
The Court, accepting the defense's arguments, applied the principle of exclusion of punishability due to the particularly trivial nature of the act, provided for by Article 131-bis of the Criminal Code.
Arrested in Ischia after a domestic dispute
The contested events date back to July 2024 and took place on the island of Ischia. The man had been stopped by Carabinierifrom Ischia following a heated domestic argument with his partner.
The situation quickly escalated: MR initially categorically refused to provide his personal details and, in a fit of rage, attacked the responding officers, sparking a scuffle. The Forio d'Ischia officers reported a five-day jail sentence. The man was then forcibly subdued and taken into custody.
The judicial process was swift and complex. At the validation hearing, the arrest was confirmed, but the defendant was immediately released at the joint request of the Public Prosecutor and the Defense.

Once the summary trial was ordered, the defense requested a deadline to prepare their arguments, leading to the postponement of the trial until September 24, when the trial actually began with the formula of immediate trial.
During the preliminary investigation, both the officers involved in the arrest and the defendant's partner were questioned as eyewitnesses.
In his closing argument, the prosecutor had requested a severe sentence: one year and eight months in prison.
However, after defense counsel Massimo Viscusi's argument, the Court, fully accepting the extensive legal arguments presented by the defense, issued a verdict of acquittal. The conduct, while acknowledged as having occurred, was deemed "minor," resulting in the defendant's innocence.
