Portico di Caserta – The Preliminary Investigations Judge of Santa Maria Capua Vetere, Dr. Pasqualina Maria Gaudiano, has accepted the Public Prosecutor's request for indictment against Gerardo Ciavattone, 46, originally from Benevento but a longtime resident of Portico di Caserta.
The man will have to answer to an exceptionally serious charge: stalking and continued acts of persecution.
The case involves two well-known local entrepreneurs, identified by the initials NM and NP, who have joined the proceedings as civil parties, assisted by lawyers Gaetano and Raffaele Crisileo.
The Persecution Spiral: From Trust to Nightmare
According to the charges, Ciavattone allegedly engaged in a series of harassing and stalking behaviors that began as early as November 2024. The trigger appears to have been his departure from NP's home, where the entrepreneur had repeatedly hosted him in exchange for help with household chores, after NP's children intervened to end the cohabitation.
From that moment on, NP's tranquility was shattered. The persecutory behavior reached its peak with dramatic episodes:
Night HarassmentThe man showed up at the victim's home several times, banging on the entrance gate with force and noise, even in the middle of the night, until two in the morning.
Telephone and Road SiegeCiavattone began making an excessive number of silent or incomprehensible calls and obsessively driving past NP's residence, forcing the entrepreneur to alter his habits and live in a constant state of fear and anxiety. The telephone siege was so severe that NP was forced to change his mobile phone number after receiving approximately fifty calls in a single day.
The escalation of violence: theft and damage
The situation escalated in early January 2025 with acts of real violence and damage:
Market Theft: On one occasion, Ciavattone reached his victim at the Curti market, approached NP's car and took documents from inside, opening the vehicle door.
Baseball Bat Raid: On the same day as the fifty calls, the defendant allegedly used a baseball bat to damage NP's car parked in Portico di Caserta, shattering the rear brake lights.
The final threat to the son
The culmination of the charges concerns the intimidation directed at the victim's son, NM, who was in turn harassed with numerous phone calls: Ciavattone is accused of threatening him by pointing a gun in his direction.
Dr. Gaudiano therefore ordered the indictment, acknowledging the validity of the charges, which describe a persistent state of anxiety and well-founded fear for the safety of the victims. The trial is now awaited to shed full light on the serious facts alleged.
