The Court of Auditors acquits a Salerno school assistant in the "diploma mill" case:

"If the work is done, not a single euro is refunded." A new, landmark principle has been established.

A landmark ruling that will curb claims for salary reimbursement in cases involving irregular educational qualifications. The Milan Court of Auditors has acquitted a school assistant (ATA) from Salerno implicated in the investigation into so-called "diploma mills," establishing a key principle: if the work was actually performed, there is no financial loss, regardless of whether the qualification was formally declared at the time of hiring.

The legal case involved LS, who, like many other colleagues in the education sector, had been targeted by the Public Accounting Prosecutor's Office at the instigation of the Ministry of Education. The accusation: having received the salary for years based on an expert's diploma obtained in 2012, which was later revealed to be irregular. The Ministry demanded the restitution of all the sums received.

The defense, led by labor lawyer Danilo Albano, turned the tide of the trial, decisively changing the prosecution's line.

The thesis, later fully accepted by the judging panel, was simple and at the same time revolutionary: damage to the public coffers occurs only if the employee has not worked.

If, on the other hand, he has performed his duties regularly and without complaint, he has a full right to remuneration, by virtue of the principle "work done, wages due", enshrined in Article 36 of the Constitution.

The Court ruled that, in cases such as these, any irregularities concern only the competition and recruitment phase, and could violate the rights of other candidates. Once that phase is over, however, and the service has been effectively rendered, the employment relationship is consolidated and the right to remuneration becomes inviolable.

"This decision represents a fundamental step," comments attorney Albano, "because it recognizes and protects the worker's rights, separating the validity of the qualification from the right to be paid for the work actually performed. This is a principle of legal civilization that will impact all national case law regarding public employment."

The ruling, therefore, not only restores peace of mind to the Salerno school worker, but also sets a clear precedent for thousands of similar cases, protecting the paychecks of all those public employees who, despite formal flaws, have worked honestly for years. A verdict that makes work performed the only true currency for a right to a salary.
