Naples' nightlife scene: the Regional Administrative Court rejects the appeal: the city's crackdown on the historic center passes the first test.

Naples - The Campania Regional Administrative Court (TAR) has rejected the precautionary appeal filed by eight local businesses, confirming the full validity of the ordinance signed by Mayor Gaetano Manfredi on November 4th.

This decision, while not settling the dispute, marks a crucial step in a matter that has become a political and social issue in recent months.

The Municipality's crackdown: what the ordinance provides

The measure, valid for two months and applied in the area between Piazza del Gesù, Via Domenico Capitelli, Vico Quercia, Via Nina Moscati and Vico Cisterna dell'Olio, aims to reduce night-time chaos and restore tranquility to residents, who have long been fighting against noise, crowds and the uncontrolled sale of alcohol.

The key measure is a ban on the sale and takeaway of alcoholic and non-alcoholic beverages from 22 p.m. to 6 a.m. This is complemented by restrictions on commercial closing times:

0.30 from Sunday to Thursday,

1.30 on weekends,
with a thirty-minute grace period for the arrangement of external spaces.

The municipality defended the decision as an attempt to strike a balance between the right to social interaction and the need to ensure a good night's sleep, while also announcing increased security and continuous noise monitoring in the most critical areas.

The Regional Administrative Court (TAR): "The damage is only financial; there's no urgency."

In rejecting the precautionary appeal, the TAR emphasized that the damages complained of by the operators are essentially financial in nature, linked to the "projected mere reduction in revenue during the pre-Christmas period."
According to the judges, financial damage is not sufficient to recognize the "extreme gravity and urgency" of the matter, justifying the immediate suspension of the order.

The matter will be re-examined collegially in the council chamber, which has already been scheduled for December 16, a date that could change the balance of the dispute.

The controversy: traders on the warpath

While the administrative courts have so far ruled in favor of the municipality, tensions remain high among merchants, who view the crackdown as disproportionate and harmful. Confesercenti Napoli e Campania has been among the most critical voices.

President Vincenzo Schiavo called the ordinance "wrongful and penalizing," denouncing the severe economic repercussions for bars, pubs, and clubs already strained by years of crisis. "Public order measures cannot fall on the shoulders of business owners," Schiavo attacked, calling on the City Council to suspend the measure and initiate broader discussions with the relevant trades.

Among the alternative proposals put forward by Confesercenti is the idea of ​​decentralizing part of the nightlife, developing new nightlife areas at the Port or the Business Center, thus easing the pressure on the narrow, highly residential streets of the Historic Center.

A political and social issue still open

The TAR's decision does not resolve a matter that remains complex and divisive. On the one hand, residents have been calling for years for decisive measures to combat nighttime chaos; on the other, businesses fear that such stringent restrictions could mark a point of no return for the commercial fabric of the historic center.

The TAR's vote offers the Municipality initial legitimacy, but the debate remains open. And on December 16th, when the court will reexamine the matter, a new chapter could emerge in a story that continues to inflame politicians, business owners, and citizens.
