Tragedy in Vomero: Compensation Arrives After 12 Years

A landmark ruling in Naples awarded over €210 in compensation to the brother of Cristina Alongi, who was crushed by a pine tree on Via Aniello Falcone in 2013. The municipality and the Ministry of the Interior were jointly held liable for failure to maintain the property.

Naples – One of the most painful episodes in Neapolitan history has ended with a civil conviction in what the lawyer calls "record" time. The Court of Naples has awarded compensation of over €210 to Elio Alongi, brother of Cristina Alongi, the woman who died prematurely at just 40 years old on June 10, 2013, when she was struck and killed by a tree.

Cristina was driving her car on Via Aniello Falcone, near the Nino Taranto Gardens, when a monumental pine tree uprooted itself, crushing and trapping her, hindering all assistance. Despite the tragedy, the battle for justice, led by lawyer Patrizia Alongi, resulted in a conviction in just two years, with the City of Naples and the Ministry of the Interior jointly liable.

A preventable death, it wasn't bad weather

"Justice has also been served in civil court with the compensation awarded to brother Elio," stated attorney Alongi. The Naples court's ruling recognized the liability of the organizations responsible for maintaining urban green spaces, dismantling the theory that the accident was caused by exceptional weather events.

"Cristina's death was not related to any meteorological event. She died on a beautiful, sunny day in June; there had been neither wind nor rain," the lawyer emphasized, emphasizing that the tragedy was the result of gross negligence.

Record times for the Naples Court

Despite the irreparable loss—"the compensatory award doesn't erase the pain of the loss," admits attorney Alongi, recalling how the tragic events were relived in the courtroom—an element of (albeit bitter) satisfaction came from the civil justice system. The ruling, in fact, came "in just two years," after hearing numerous witnesses and conducting a technical expert opinion. "This proves that the civil process in the Court of Naples works well and quickly," the lawyer comments.

Cristina's brother had waited a long time before taking legal action, after numerous requests to the institutions had gone unanswered. The indifference was total: even three formal attempts at mediation had been unsuccessful, with the City of Naples failing to show up. A strong and tangible sign of protest was the wreath sent by the Mayor on the day of the funeral, left outside the church at the family's request.

The appeal to the institutions: "Today the climate has worsened"

Today, lawyer Alongi issues a warning, in light of climate change and extreme weather events: "Unfortunately, the situation has worsened today, so institutions should be even more vigilant in protecting citizens."

Reference is made to the continuous recurrence of similar accidents, with the falling of trees, scaffolding, and cornices, for which greater vigilance is required, both public and private.

The family's final hope is that the liquidation ordered by the Court will take place quickly and spontaneously, "to at least close the judicial chapter of this painful affair."
