Naples – The Qatargate accusatory framework is shaking to its foundations. Three years after the scandal that rocked European institutions, a new judicial earthquake threatens to rewrite the investigation's history.

The arrest of the head of the anti-corruption Brussels, accused of violating the confidentiality of the investigation, becomes the decisive assist for the defense of former MEP Andrea Cozzolino, who is now loudly calling for a declaration of inadmissibility of the documents.

The lawyers' counteroffensive

Lawyers Dezio Ferraro, Federico Conte, and Dimitri Debeco, representing the former Democratic Party representative, mince no words. Currently engaged in proceedings before the Brussels Court of Appeal, the lawyers point the finger at what they call "systemic anomalies" that have tainted the investigation from its earliest stages.

The crux of the defense strategy concerns the source of the evidence. According to attorney Ferraro, the investigation suffers from a genetic flaw: "These actions were carried out primarily by the secret services, who, preemptively and abusively, sought evidence against several European parliamentarians."

This approach, the defense lawyers emphasize, directly violates current regulations in both Italy and Belgium regarding investigative powers, bypassing the constitutional guarantees reserved for parliamentarians.

The arrest that changes everything

Strengthening the theory of a "conspiracy," or at least the opaque handling of the case, is the recent arrest of the Belgian police officer. A key figure in the anti-corruption effort, the man is accused of being the "deep throat" who systematically anticipated the prosecutor's moves to a small circle of journalists, turning the investigation into a manipulated media spectacle.

"A recently revealed anomaly," Ferraro, Conte, and Debeco explain. The official allegedly gave advance warning to the press of searches and arrests that would take place within days, creating a disconnect between justice and information that would jeopardize the smooth running of the proceedings.

Defense rights at risk

The defense team's conclusion is drastic: the trial cannot be considered fair. In addition to the misuse of intelligence and leaks, the lawyers denounce the inability to access all investigative documents. "These circumstances have compromised any right to defense as well as the possibility of a fair trial," they conclude.

If the Brussels Court of Appeal upholds the objection of inadmissibility, the entire Qatargate scandal, which implicated several Italian MEPs, could crumble, turning one of the EU's biggest corruption scandals into a textbook case on the limits of the judiciary and intelligence services.
