Naples – A dramatic turn of events has taken place in the courtrooms of the Naples Criminal Court. CDP, 46, a resident of San Giovanni a Teduccio, accused of aggravated stalking of his ex-partner and mistreatment of his mother, has been released from Poggioreale prison and placed under house arrest.

This decision comes just three months after the assignment was entrusted to lawyer Massimo Viscusi, who, with a detailed and documented request, managed to convince the judge of the Ninth Section, Dr. Albanese.

The man, burdened by numerous criminal records and a repeat offender within five years, was transferred to his new partner's home, where he will be required to wear an electronic bracelet. This measure is less restrictive than prison, but it still ensures constant monitoring of his movements.

The expertise that changed everything

The turning point came with the psychiatric report submitted by the defense. The document certified the defendant's "profound incompatibility" with the prison regime, highlighting the structural deficiencies present in the Poggioreale penitentiary to manage his condition.

Since 2012, CDP has been treated by the ASL Napoli 1 for psychological disorders and is undergoing treatment at the Serd (Addiction Service). These conditions, according to experts, require ongoing therapeutic care, which is impossible to provide in prison.

The previous attempt at release, presented by the initial defense attorney and rejected by the Court of Review, had been unsuccessful. However, attorney Viscusi restructured his defense strategy, focusing specifically on his client's health and the need for adequate treatment.

From the arrest in flagrante to the trial

The 46-year-old was arrested on April 21st, caught in the act with two precautionary orders: one for stalking his ex-partner, the other for mistreatment of his mother. Attorney Viscusi successfully consolidated these two separate proceedings into a single trial, which began on October 13th with an immediate hearing.

The first hearing marked the beginning of a judicial process that is now approaching its crucial phase. The trial will resume in February, when the defendant will have to defend himself against the serious charges against him. In the meantime, CDP will be able to face trial from home, subject to the obligation to undergo the necessary treatment and electronic monitoring by the authorities.
