The 45-year-old, originally from Amorosi and resident in Castel Campagnano, who was put on trial on the serious charge of aggravated mistreatment of his mother, a disabled person, was fully acquitted because "the act does not constitute a crime."
According to the indictment, the alleged events dated back to June and July of last year, as well as the following January, when the man allegedly repeatedly demanded money from the woman, claiming it was compensation for work he had done but – in his opinion – unduly withheld by the mother.
Under those circumstances, according to the prosecution's reconstruction, the suspect allegedly attacked her, triggering the investigation and, subsequently, the indictment.
In light of the expert findings, the Prosecutor's Office deemed the man to be suffering from partial mental illness, attributable to a long-standing form of bipolar disorder, and requested and obtained a probation order to ensure his continued treatment.
The case then proceeded to immediate trial before Panel B of the Court of Santa Maria Capua Vetere, presided over by Dr. Maione. During the hearing, the defendant's defense, represented by criminal lawyer Massimo Viscusi, developed a detailed line of argument, contesting the existence of the typical elements of the crime of mistreatment and the legal classification of the alleged facts.
Today, the Court, fully accepting the defense's arguments, acquitted the man "because the act does not constitute a crime." The Santa Maria Capua Vetere Prosecutor's Office had already taken the same line, having also concluded at the hearing that the man should be acquitted.
