The Regional Prosecutor's Office of the Court of Auditors is suing de Magistris for damages of €2,7 million for the bankruptcy of CTP, the metropolitan city's local transport company. This new legal case adds to an already long list: what de Magistris calls "proceeding number 110" against him since he began his career as a public prosecutor in 1995.
"I firmly dispute the charges," the former metropolitan mayor declared. According to his reconstruction, CTP It was close to being rescued when his term ended. The final blow would have come from the new administration and the Campania Region's decision to privatize the service rather than complete the restructuring process.
The crux of de Magistris's defense can be summed up in a rhetorical question: "Should I have acted differently from the proposals of the general manager, general secretary, and auditors, all of whom agreed on making the company safe? Should I have let it fail?" The actions, he argues, were supported by administrative, technical, and accounting opinions, as well as by the unanimous vote of the metropolitan council, representing all political factions.

A topic that reignites the debate over the management of public sector crises in Naples. De Magistris cites the "successes" of his administration: the resolved waste emergency, the new subway trains, the recovery of the municipal budget in 2011 when he found "the institution without a cent in its coffers." These actions, he claims, saved "thousands of jobs" and averted bankruptcy.
"I maintain my faith in the judiciary," de Magistris concluded, promising to approach the proceedings "with the same strength as always" and reiterating his conviction that he acted in compliance with the Constitution and the public interest.
