Aversa, 13-year-old stabbed to death: after 13 years, the sole defendant is acquitted.

The Naples Court of Appeals has definitively closed the trial into the death of Emanuele Di Caterino, killed in 2013 during a fight between two teenagers. Self-defense was recognized. The boy's mother shouted "shame" in the courtroom.

After nearly thirteen years, one of the most painful and controversial legal cases in the Caserta area has come to a close. The Naples Court of Appeal has acquitted the sole defendant in the murder of Emanuele Di Caterino, the 13-year-old stabbed to death on April 7, 2013, in Aversa, during an argument between teenagers.

The defendant, now 29 but still a minor at the time of the incident, was accused of fatally attacking the young man during a street fight. This tragedy shocked the Aversa community and triggered a long and complex legal process, marked by conflicting rulings, postponements, and retrials.

Over the years, the case has gone through several levels of adjudication, with an initial conviction, subsequent appeals, and a new appeal hearing ordered to reevaluate the circumstances of the case and the defendant's position. At the heart of the proceedings was the reconstruction of the brawl and the assessment of criminal responsibility in a context of sudden violence between very young people.

At the last hearing, the Deputy Prosecutor General had requested an acquittal, arguing that the stabbing had occurred in self-defense. This argument was upheld by the judges of the Naples Court of Appeal, who acquitted the defendant, thus bringing to an end a proceeding that had lasted over a decade.

As the verdict was read, a tense moment unfolded in the courtroom. Emanuele Di Caterino's mother, devastated by grief and anger, shouted "shame!" at the judges. It was a cry that summed up the suffering of a family who, after thirteen years of waiting, sees the trial end without a conviction.

With this ruling, the judicial curtain finally falls on a tragedy that remains, however, an open wound in the memory of the city of Aversa.

The most absurd and horrific thing, which everyone feared, has unfortunately happened! The murderer was even acquitted, despite already having the knife with which he stabbed poor Emanuele in the back and also nearly killed four other defenseless boys! And he was even granted self-defense, even though everything was perfectly documented by cameras! This is "justice" and these are the "magistrates" we have in Italy! I truly no longer know what to think of those who asked for acquittal and those who even granted it with the sentence! In fact, I prefer not to say what I truly think, to avoid committing a crime against those who are supposed to be the representatives of our country! Do you see how bad things are? Our country has hit rock bottom, as it unfortunately has already done several times, but each time it gets worse! These are the moments when anyone with a conscience would like to cry out: "Tell me this is a nightmare! Tell me we're waking up!" But sadly, it's all true, and this is the chilling reality! If the murderer had even a shred of conscience, he would have immediately told the judges at sentencing: "You made a mistake! It's my fault! Give me the maximum sentence!" Only this would restore his honor and dignity! And it would also be wishful thinking to hope that remorse and Emanuele's image would torment him more and more each day until he makes this sacrosanct confession! And it would be equally wishful thinking to hope that the same remorse will always torment the so-called "judges" who requested and issued this sentence! I hope, however, that all possible avenues can be explored to appeal to the CSM and, if necessary, to the European Court of Justice. Provided, of course, that these institutions retain even a modicum of awareness of the meaning of the word "justice"! A big hug, with all my sympathy, to Emanuele's parents and family, especially to this poor, heartbroken mother! And all my support and encouragement to their lawyers, so that, without a moment's respite, drawing on all their experience and expertise, they can finally lead their clients and the public at large out of this nightmare, allowing us to finally awaken to a country where the concept of justice still exists!
