Casoria, acquitted after 8 years on charges of mistreatment: The fact does not exist

The case against a 48-year-old local man has been dismissed: the court did not find the repeated conduct and the state of subjugation of his wife and children described by the Prosecutor's Office.

Casoria – After nearly a decade, a long and troubled legal case has come to an end for FI, a 48-year-old from Casoria, who was brought to trial on serious charges of domestic abuse.

Eight years after the complaint was filed, the panel of judges issued a full acquittal "for not having committed the crime", restoring the man's honour.

The case and the accusations

The case began in 2016. According to the Prosecutor's Office's reconstruction, the defendant allegedly committed a series of physical and psychological abuses against his partner and minor children over a period of years.

The picture painted by the prosecutor described a climate of domestic terror: verbal assaults, death threats, and physical violence ranging from slaps to attempted suffocation, often—according to the prosecution's hypothesis—under the influence of narcotics.

The prosecution aimed to demonstrate "ongoing conduct" that made the woman's life impossible, aggravated by the presence of her young children, involuntary witnesses to the alleged abuse.

The verdict

Despite the severity of the accusation, the trial in court overturned the premises. The defense, represented by attorney Rosario Arienzo, successfully undermined the prosecution's evidentiary system.

In particular, during the trial, no evidence was obtained of the repetition of the behavior, nor of the state of psychological subjugation in which the victims were supposedly found. These are essential elements for establishing the crime of mistreatment (pursuant to Article 572 of the Criminal Code).

At the end of the closing argument, despite requests from prosecutor Marco Iojodice, the judge accepted the defense's arguments, decreeing the end of the judicial nightmare for the 48-year-old, who emerged unscathed from an eight-year trial.

The acquittal seems fair, but many questions remain unanswered. Even if the man was found innocent, the victims may still have suffered. Justice is sometimes complicated.
