Casoria – The prosecutor had requested detention, but the investigating judge of the Northern Naples Court upheld the arrest and ordered a less severe measure: a ban from residing in Casoria, resulting in his release. The investigation and the accusation
Domenico Chianese was arrested in Casoria two days ago and investigated for possession of narcotics for the purpose of dealing.
According to the charge, he was in possession of various substances already divided into doses: 4,4 gross grams of cocaine (17 sachets), 1,6 gross grams of marijuana (1 sachet) and 10,8 gross grams of hashish (5 sachets).
Street control and seizure
The Carabinieri noticed him in the Piazza San Paolo area, near the supermarket, as he looked around and then tried to walk away.
During the search, according to the documents, he allegedly tried to get rid of a black sock by throwing it under a car: inside, two metal boxes containing baggies of cocaine were found, as well as marijuana and hashish, and on him were small denomination cash and additional banknotes.
At the validation hearing, Chianese availed himself of the right to remain silent, but made a voluntary statement admitting the charges and apologizing.
The defense lawyer did not oppose the validation and requested a less punitive measure, while the Prosecutor's Office had requested pre-trial detention.
The preliminary investigations judge's decision: no prison, residence ban
The investigating judge validated the arrest and, as a precautionary measure, found there were serious grounds for suspicion and a risk of reoffending. However, instead of a prison sentence, he imposed a ban on residence in the municipality of Casoria, ordering his immediate release and imposing a requirement to be available and report to the Carabinieri station.

I read the article and it seems to me that the preliminary investigations judge's decision was correct, but I don't understand why he was given a residence ban instead of prison custody; perhaps there are reasons we don't know.
