A man died in a well-known Neapolitan hospital after a trivial domestic accident. A family devastated by grief. And now a ruling acknowledging serious medical liability: the Court of Naples has ordered the ASL Napoli 1 Centro to pay approximately €600 to the victim's wife and son.
According to the trial, the patient had been hospitalized after suffering an orthopedic injury in a domestic accident. However, he suffered from serious heart problems, a condition known to the medical staff, who, however, chose to focus exclusively on his orthopedic injuries. This fatal error led to a progressive deterioration in his health, culminating in heart failure and death.
He was admitted to a ward unsuitable for the complexity of his overall clinical condition. The patient apparently did not receive the specialized care necessary for his heart condition, a failure the judges deemed crucial to the tragic outcome of the case.
"This ruling reaffirms the principle that the patient must be evaluated as a whole and not limited to individual clinical profiles," stated the lawyers of the Maior Law Firm (Pierlorenzo Catalano, Michele Francesco Sorrentino, and Filippo Castaldo), who assisted the family with the assistance of medical examiner Marcello Lorello.
For the lawyers, the court's decision "restores justice to the family and reminds healthcare facilities to respect the most basic duties of care and supervision." The judges characterized the clinical management as "serious," with direct responsibility attributed to the doctors who treated the patient.
The case once again raises the issue of comprehensive patient care, especially when multiple pathologies are present. The ruling serves as a warning to hospitals: treating the most obvious symptom isn't enough; the entire clinical picture must be assessed to ensure adequate care and avoid avoidable tragedies.
