The case of the newborn who died at the Monaldi Hospital in Naples is not over. Preliminary Investigations Judge Federica De Bellis has rejected the prosecutor's request to dismiss the case and ordered further investigations to shed full light on the baby's death, which occurred on February 16, 2024, when he was just two and a half months old.
The newborn was hospitalized awaiting critical heart surgery for a congenital condition, but according to the parents, who filed a complaint after the tragedy, assisted by lawyer Tommaso Ciro Civitella, the death was not solely attributable to the ventricular septal defect diagnosed at birth. At the heart of the complaint is the suspicion that medical malpractice may have been involved in the clinical course preceding the death.
Accepting the family's requests, the investigating judge deemed it necessary to conduct a further technical investigation to determine the possible impact of a hospital-acquired infection and the impact of the pharmacological treatments administered on the child's deterioration. This step was deemed essential to clarify whether factors other than the heart condition contributed significantly to the child's clinical evolution, which, in the final days of his life, was marked by repeated cardiac arrests.
The judge's decision therefore reopens the case and requires further investigation, with the aim of determining all possible responsibilities and providing definitive answers to a family seeking truth and justice for their son's death.
