The defenders of Rosalia Masi, former mayor of San Vitaliano from May 15, 2023, to May 13, 2025, have taken a stand regarding the temporary closure of the municipal cemetery.
Lawyers Luca Capasso and Michele Russo have released a statement clarifying the aspects emerging from the official documents, contesting the media reconstructions circulating on the matter.
The ordinance and the ASL inspection
The order closing the cemetery was issued by the deputy extraordinary commissioner after an inspection by the ASL Napoli 3 Sud carried out "several months after the events involving the former municipal administration."
The order highlights structural and health and hygiene issues discovered at a later date and, the lawyers specify, "contains no reference, direct or indirect, to responsibilities attributable to Mrs. Rosalia Masi."
The defense attorneys define any attempt to link the current situation of the cemetery to their client's personal situation as "lacking factual and legal basis." This would be an "arbitrary comparison" that risks distorting reality and fueling a suggestive narrative unsupported by official documentation.
The position of the defense
"Rosalia Masi is not involved in the allegations cited in the administrative order," Capasso and Russo state bluntly. At present, they point out, there is no judicial evidence that would justify a different conclusion. The defense "firmly rejects any overlap between subsequent technical assessments and personal matters already the subject of separate judicial proceedings."
The former mayor, her lawyers assure, will approach the legal process involving her "with serenity and determination," confident in a fair judgment based on facts and evidence, "and not on media reports or political spin."
The lawyers announce that they will continue to protect the honor and rights of their client in all competent venues, reserving the right to take any action in the event of untrue statements or connections.
