The Third Section of the Review Court of Brescia (President Pagliuca) annulled, referring the case back to another appeal section, the precautionary measure limited to certain aspects of the charges against five defendants.

The measure concerns the crime of drug trafficking and the aggravating circumstance of the so-called "mafia method." The judges noted flaws in the reasoning regarding the existence of the constituent elements of the association and the contested methods.

The measure: house arrest starts

Following the preliminary hearing's decision, the same five defendants were placed under house arrest. Among them is Paolo Russo, from Villaricca, who is associated with the Mallardo clan and is being defended by the lawyer Massimo Viscusi.

The context: the "Notte Bianca" investigation

The measure is part of the investigation called "Notte Bianca," coordinated by the Brescia DDA, which involves a total of 15 people belonging to various clans of origin operating in the north (Ndrangheta, Camorra Alleanza di Secondigliano, Mafia Catanese Santapaola). The suspects are accused, to varying degrees, of an association aimed at trafficking and dealing in narcotics, particularly cocaine and marijuana.

"Pure" and broken cocaine in Gioia Tauro

According to the prosecution's argument, the cocaine—defined as "ultra-pure" in the investigative documents—arrived through the port of Gioia Tauro and was then distributed to various locations across the country.

Reading the article, it seems to me that there are many complexities surrounding the issue of drug trafficking. It's interesting that the precautionary measure was revoked. However, questions remain about how these investigations are conducted and the consequences for those under investigation.
