Benevento – A tragic outcome to the violent attack that occurred last month in the densely populated Rione Libertà neighborhood. The heart of Mario Capobianco, a 68-year-old from Benevento, stopped beating at the San Pio Hospital, where he had been hospitalized in desperate conditions since the evening of January 24th.
The injuries he sustained during the beating, particularly the head trauma, were too serious to survive despite doctors' attempts to save his life.
The dynamics of the beating
It all began with a trivial argument over a romantic relationship with a family member. Words quickly escalated to physical violence: according to investigators' reconstruction, AM, a 37-year-old local man, allegedly attacked the elderly man.
The victim was kicked and punched, a fury that didn't subside even when the 68-year-old man was defenseless on the ground. In a desperate attempt to protect her husband, Capobianco's wife also intervened, but was also attacked and sustained injuries that were later reported by the emergency room of the Sannio hospital.
The charge is changed
Capobianco's death significantly aggravates the 37-year-old's situation. AM had been placed under house arrest by the Benevento Carabinieri on the orders of Deputy Prosecutor Dr. Giulio Barbato, charged with grievous bodily harm.
With the victim's death, the prosecution's case is set to change radically: in all likelihood, the Prosecutor's Office will proceed in the next few hours to reclassify the crime as voluntary homicide.
The case is now moving to the judicial and forensic level. The victim's family, his wife and children, have appointed lawyer Vittorio Fucci to assist them in this painful phase of the proceedings. The suspect, who will now face charges for the man's death, is being represented by lawyer Vincenzo Sguera. An autopsy may be performed in the coming hours to determine the definitive causal link between the beatings and the death.
