Jlenia Musella's murder: Defense video: "Giuseppe didn't run away; he was in the hospital."

The suspect's lawyers are relying on a video shared on social media to refute the theory that he fled after the attack. But the investigating judge hasn't believed the knife-throwing theory. The autopsy revealed a tiny lesion in the aorta. Final results are pending.

Giuseppe Musella allegedly didn't abandon his sister in front of the emergency room and run away. This is one of the lines of defense put forward by lawyers Andrea Fabozzo and Leopoldo Perone, who are referring to a video that has gone viral on TikTok in the last few hours.

The video shows the young man leaving the emergency room at Villa Betania Hospital in Ponticelli, bare-chested, with his mother. Giuseppe Musella is present when the doctors tell the woman the news of her daughter Jlenia's death.

He doesn't move away, he doesn't run away. He sits on the wall in the ambulance entrance, puts his hands on his forehead, squeezes a cigarette between his fingers, and remains silent while his mother screams in despair, supported by another young man.

For the defense, those images would demonstrate the absence of any immediate escape behavior after the attack.

The man remains in prison: the motive is still unclear.

Giuseppe Musella is currently being held in Secondigliano prison and, according to the documents, has not yet definitively clarified the motive that led to the argument that culminated in fatal violence.

Investigators are awaiting further evidence from forensic tests to clarify every aspect of the incident, which remains the subject of a complex judicial reconstruction.

The autopsy: the lesion to the aorta was decisive

The first clear conclusion comes from the autopsy, performed concurrently with the arrest hearing. According to preliminary findings, Jlenia's death was caused by a tiny lesion in the aorta, which was deemed sufficient to cause a fatal hemorrhage.

During the examination, a lung lesion was also found, but this is not considered a cause of death. A definitive diagnosis will be made after the medical-legal report is submitted, expected within 60 days.

The defense's version: "The knife was thrown, not held."

Commenting on the initial autopsy results was lawyer Andrea Fabozzo, who represents Giuseppe Musella along with his colleague Leopoldo Perone.

"According to what our consultant, who was present at the autopsy, reported, it is plausible to believe that Jlenia's back wound was caused by the knife being thrown," the lawyer explained.

Fabozzo specified that further tests will be necessary for a definitive evaluation, but reiterated that the injury to the aorta could be compatible with the impact of a thrown and unheld weapon.

The family quarrel and the confession

According to investigators' reconstruction, the murder apparently arose following a family argument that broke out because the young woman had injured the dog to which her brother was particularly attached.

After his arrest, on the night between February 4th and 5th, Giuseppe Musella confessed to the Flying Squad, claiming he had thrown the knife without intending to kill his sister. This version was also confirmed before the judge during the validation hearing.

The investigating judge doesn't believe the knife was thrown

This theory did not convince investigating judge Maria Rosaria Aufieri, who upheld the arrest for aggravated voluntary homicide and ordered his remand in prison.

According to the judge, the theory of a thrown knife "does not hold up": such a dynamic would presuppose "coolness and courage," incompatible with the suspect's subsequent behavior. The investigating judge, however, concluded that the fatal wound was inflicted at close range.

Deleted social media and attempts to mislead

The judge's decision was also influenced by his conduct following the murder. According to the order, Giuseppe Musella attempted to suppress evidence by deleting his social media profiles in an attempt to construct an "alternative truth" about what happened.

For these reasons, the defense's request to reclassify the crime from voluntary to unintentional homicide was rejected.
