Compensation exceeding €500 for the death of a patient undergoing fatal surgery was awarded by the Court of Naples, which found a facility within the Naples Local Health Authority (ASL) guilty of serious medical negligence in its handling of the case.
According to the court's findings, the man had undergone abdominal surgery that was deemed incorrectly indicated and performed with critical surgical procedures. This was compounded by post-operative management described as "severely deficient." The patient subsequently developed severe metabolic decompensation that preceded his death.
The expert reports were crucial, confirming omissions, delays in interventions, and the lack of clear protocols. These factors, according to the judges, aggravated the patient's clinical condition, causing intense and prolonged suffering, recognized as "catastrophic damage."
The family was awarded compensation for the loss of parental ties and for the moral damages suffered. They were represented by attorneys Pierlorenzo Catalano, Michele Francesco Sorrentino, and Filippo Castaldo of Studio Associato Maior.
"This ruling represents an important sign of protection for citizens and a reminder to strictly adhere to clinical and healthcare protocols," the lawyers stated. "It reaffirms the right of patients and their families to obtain justice in cases of medical malpractice." The lawyers also emphasized the symbolic value of the ruling. "We are proud to have given a voice to the victim's family and to have achieved a result that strengthens the culture of responsibility and healthcare safety."
