The Audero case has reached the sports justice system and opens up scenarios that could have serious consequences for Inter, especially regarding sanctions related to the stadium. Lawyer Roberto Afeltra, an expert in sports law, shed light on the situation in an interview with Radio Anch'io Sport on Rai Radio 1.

"The firecracker did not hit the athlete, even though it caused immediate damage. The fact that the athlete was able to continue and finish the match precludes the application of the maximum sanction," the lawyer explained, immediately outlining the perimeter within which the sports judge could operate.

According to Afeltra, the most concrete options involve measures affecting the stadium and the fans. "We'll have to see what the penalty will be: a fine, the closure of a section, playing one or more matches behind closed doors, or closing off more parts of the stadium. A points deduction for Inter? No, that's not on the cards."

The lawyer also held back on predictions, though he did indicate a clear direction. "I'm not used to making predictions, but the sanction the club could receive could range from the closure of a section of the stadium for a certain period of time to playing a match behind closed doors. We shouldn't go beyond that."

The scenario would have been different if the consequences for the goalkeeper had been more serious. "If the goalkeeper had had to leave the field partially or permanently, there could have been a risk of a forfeiture," Afeltra added, clarifying how the continuation of the match played a decisive role in the legal assessment of the incident.

The issue then broadens to include the clubs' strict liability, especially for any disturbances that may occur outside the stadium. "This is an issue we need to discuss and find a solution to. In my humble opinion, clubs cannot be held strictly liable for events that were not only unavoidable but also foreseeable, beyond the clubs' ability to prevent incidents. The penalties should be very different."

The article discusses a very complex case, and there are many factors to consider, but in my opinion, a company shouldn't be punished for something they can't control. Strict liability is a sensitive issue.
