Naples – The family of little Domenico Caliendo, assisted by lawyer Francesco Petruzzi, is requesting that the investigation conclude with a charge of voluntary manslaughter.
"From the examination of the medical records, there are all the conditions to establish possible intent," the lawyer declared, thus ruling out the possibility of manslaughter.
The hypothesis of eventual intent
According to the defense attorney, the medical documentation indicates a conscious act of the risk associated with using the organ. "It's highly plausible that there was intent, which would constitute voluntary manslaughter and not manslaughter," Petruzzi reiterated during his appearance on the Retequattro television program "4 di Sera Weekend," alongside the child's mother.
The investigations of the Prosecutor's Office
The Naples Prosecutor's Office will now determine whether the criminal charges alleged by the defense exist or whether little Domenico's death should be attributed to medical negligence. The investigation will focus on the condition of the transplanted organ, the evaluation procedures, and the clinical decisions that preceded the procedure.
