Naples—The Naples prosecutor's office is widening its investigation into the fatal heart transplant for Domenico, the two-and-a-half-year-old boy who died last Saturday in the intensive care unit at Monaldi Hospital.

A seventh staff member at the facility has been placed under investigation. This news emerges as the prosecutors in charge of the case formally requested an evidentiary hearing ahead of the autopsy and the joint medical-legal assessment.

With this latest addition, the number of healthcare workers under investigation for the minor's death rises to seven. The provisional charge is conspiracy to commit manslaughter, involving separate but converging acts: negligence, recklessness, and incompetence, aggravated by the alleged violation of guidelines for the preservation and transport of organs intended for transplant, as well as good clinical, healthcare, and surgical practices.

Evidentiary incident on autopsy and collegial expert report

The Prosecutor's Office has requested that the technical findings—the autopsy and forensic examination—be finalized with an evidentiary hearing, to ensure their use in the remainder of the proceedings. The request will be examined by the preliminary investigations judge in the coming days.

The panel of experts will be tasked with reconstructing the clinical and organizational sequence that preceded and followed the transplant, determining any potential liability and the causal link between the contested conduct and the fatal outcome.

Organ removal, transportation and implantation under examination

Among the questions posed to the consultants, the Prosecutor's Office highlights the need to verify compliance with guidelines during the procurement, preservation, and transportation of Domenico's heart, as well as the appropriateness of the surgical and therapeutic choices made. The condition of the organ at the time of implantation and the appropriateness of the procedure in relation to the timing and method of arrival of the removal team in the operating room will also need to be assessed.

The outcome of the technical tests will be crucial in determining whether the transplant failure is due to critical issues in organ management or clinical decisions deemed noncompliant with medical practice standards. Meanwhile, the investigation continues with the acquisition of medical records and the facility's operating protocols.
