Pimonte – Antonio Chierchia's judicial ordeal ends with a full acquittal, based on his lack of involvement in the crime. After more than a year in prison, the Torre Annunziata Court (President Aufieri, with Salzano and De Simone acting as assistants) overturned the indictment against the defendant, charged with extortion aggravated by mafia methods.
The investigation and the accusatory theorem
The case began two years ago in March, during an investigation conducted by the Torre Annunziata Operations Unit. According to the District Anti-Mafia Directorate's theory, Chierchia exerted unlawful pressure on the owner of a company involved in the redevelopment of the "San Michele" sports field in Pimonte.
Investigators initially linked the incident to the criminal dynamics of the Afeltra-Di Martino syndicate, which dominated the Monti Lattari area. Based on these findings, the DDA prosecutor requested a severe sentence: six years in prison.
The eye recognition knot
The heart of the trial revolved around a seemingly rock-solid piece of evidence: the racketeering victim had formally identified Chierchia three times, both during the preliminary investigation and during the courtroom trial.
Despite the three positive "face-to-face" confrontations, which usually strengthen the prosecution's position, the defense succeeded in undermining the credibility of the reconstruction. Attorney Francesco Romano, through a detailed defense investigation, brought to the magistrates' attention a series of flaws and inconsistencies in the victim's account, demonstrating the defendant's innocence regarding the alleged facts.
The return to freedom
The ruling by the Oplonti Court ends Chierchia's 15-month pretrial detention. The judges, accepting the defense's arguments, highlighted that the facial recognition test was not supported by reliable objective evidence, thus releasing him. It remains to evaluate the victim's position and the reasons for the ruling, which will be released in the coming weeks, to understand how the mismatch between the accusation and the actual facts occurred.

The sentence seems a bit strange to me, especially after the victim recognized Chierchia three times. I don't know if it's right that someone can be released so easily; there are too many unanswered questions.
