Naples – The criminal proceedings against Pino Grazioli have concluded with a ruling dismissing the case. He was acquitted pursuant to Article 129 of the Code of Criminal Procedure due to inadmissibility due to the lack of a complaint, as provided for in Article 152, paragraph 3, of the Criminal Code.
The man had been reported by the well-known entrepreneur linked to the Napolitano Store brand for alleged crimes related to aggravated defamation (articles 81 paragraph and 595 of the Criminal Code).
During today's hearing, the injured party—who had not even filed a civil action—attempted to obtain a postponement through his attorney, filing a motion for legitimate impediment based on work commitments. This request was denied.
Furthermore, according to what emerged in court, the handwritten notifications indicated by the public prosecutor remained unrecorded, a circumstance that was not proven by the prosecution.
Given the lack of a valid complaint and the absence of grounds for proceeding, the judge declared the case inadmissible, definitively ending the trial before the trial even began. Grazioli was represented by his trusted attorney, Massimo Viscusi. The opposing party was represented by Rocco Maria Spina.
