The two-year prison sentence for illegal betting intermediation against the manager of a Neapolitan betting shop has become final. The Court of Cassation has rejected the defendant's appeal, fully upholding the Naples Court of Appeal's ruling in the second instance.

At the heart of the proceedings was the management of bets placed on a foreign site lacking the authorizations required by Italian law. According to the lower courts, the activity was not limited to personal bets, but rather constituted actual intermediation on behalf of third parties. Key to this was the evidence collected during the investigation, including receipts and notes—both handwritten and digital—containing names associated with sums of money.

The Supreme Court's reasoning emphasizes that the fact that the bets were placed within the business belonging to the defendant's family constitutes significant evidence of a commercial activity. The seized documentation, listing names and amounts, was deemed consistent with the systematic management of bets on behalf of other individuals.

In declaring the defense's objections inadmissible, the Supreme Court judges reiterated that the assessment of evidence and reconstruction of facts are the responsibility of the lower courts, provided they are supported by logical and coherent reasoning. The Supreme Court also held that the decision not to grant a suspended sentence was correct, given the risk of reoffending and the presence of specific precedents.
