APEX – She was accused of embezzling approximately €20 from the owner of the business where she worked as a cashier, with the aggravating circumstance of having acted deceitfully, abusing her position, and causing significant financial damage. However, the Benevento Court found those charges did not stand up to scrutiny at trial.
The legal case ended with the acquittal of the 39-year-old woman from Apice, represented by the lawyer Vittorio Fucci. The owner of the business, who joined the civil action and was represented by the lawyer Elena Cosina, had filed a complaint claiming that the employee had stolen the proceeds from the sale of cigarettes, drinks and scratch cards.
According to the prosecution's charges, the woman withheld part of the proceeds by failing to deposit them regularly, temporarily leaving the money in uncontrolled areas and then stealing it. She was also accused of recording lower amounts than the receipts issued and of using the "exchange" item instead of issuing the tax receipt, thus concealing the shortfall. The prosecution also alleges that these actions were carried out by circumventing the video surveillance system.
This would have outlined a case of aggravated theft, aggravated by the abuse of her position as a cashier and the alleged skill in circumventing security checks. However, at the end of the trial, the court upheld the defense's arguments, acquitting the 39-year-old.
