Avellino – The complex legal case involving MVC, a 60-year-old lawyer from Cervinara, has concluded with a ruling dismissing the case. The Avellino Court, fully accepting the defense arguments presented by attorney Vittorio Fucci, has brought an end to a tortuous trial marked by reversals and Supreme Court decisions.
The Supreme Court's overturning
Today's verdict comes approximately a year after a landmark decision by the Second Section of the Court of Cassation. The Supreme Court, granting the appeal for rescission of the judgment filed by attorney Fucci, overturned the conviction against the professional.
The lawyer had made national headlines for being accused of fraud, aggravated by a specific recidivist. According to the prosecution, she had falsely passed herself off in the past as the sister of a well-known magistrate.
From prison to acquittal
The MVC case is emblematic for its temporal evolution: the woman had been convicted in the first instance in Avellino, a sentence later confirmed both by the Court of Appeal of Naples and, initially, by the Supreme Court itself.
Because of that verdict, which became final, the lawyer had already served her sentence. However, the defense's subsequent legal victory in the Supreme Court reopened the case, leading to the conviction being overturned and a new trial being held before the Irpinia Court.
In the new trial, attorney Vittorio Fucci's defense strategy successfully demolished the prosecution's case. The Avellino Court finally ruled the case closed for the well-known Cervinara-based professional, bringing to an end a years-long legal ordeal.
It seems to me to be a very complex affair, I am not a neutral judge; we read that the Supreme Court overturned everything, then the Tribunal closed, but doubts remain about how it was handled, the woman was first paid the penalty, then acquitted, a whole strange turn of events that leaves one perplexed, without sufficient explanations.
I don't really know what to say, the whole affair almost always seems like an endless series of papers and sentences that went around, Mrs. MVC was convicted and then acquitted but the judge changed his mind, so often that it seems like a puzzle, the trial was very long and difficult for everyone and for the community.
