Naples – The case of Domenico Caliendo, the two-year-old boy who died after a heart transplant performed at Naples' Monaldi Hospital, continues to spark controversy. Amid internal investigations, judicial investigations, and controversy over healthcare management, the case is now being further enhanced by new statements from the family's defense team.
Francesco Petruzzi, the lawyer representing the child's parents, intervened after a public letter was signed by Anna Iervolino, the general director of the Colli Hospital, detailing the measures taken after the tragedy.
"I believe the general manager": the story of the meeting
According to the lawyer, the position expressed by the general director confirms what had already emerged during a meeting with the family.
"I attended a meeting with Dr. Iervolino," Petruzzi explains, "and this is the second time I've heard her speak directly on the matter. I believe her."
The lawyer reports that, during that meeting, the manager clarified that she had immediately ordered internal audits to verify what happened after the surgery.
One point, however, was particularly significant: the request addressed to the health workers involved to know whether the child's mother had been informed of every clinical detail.
The issue of communications to the mother
According to the family, the response given to the health management was false.
"In her office," the lawyer recounts, "she told us she'd asked if everything had been reported to Domenico's mother, and she'd been assured it had been. In fact, they'd been lied to, too."
This circumstance, if confirmed by judicial investigations, would open up new scenarios regarding internal responsibilities and the management of communications between the medical team, healthcare management, and the patient's family.

According to lawyer Petruzzi, the contested behavior does not only concern relationships with the child's family.
"It appears that this group of doctors acted improperly not only towards Mrs. Patrizia, Domenico's mother, but also towards the health and general management itself," he states.
According to the defense's reconstruction, the hospital's management was falsely informed that all the information had been communicated to the family members.
The shadow of forgery in medical records
Another issue concerns medical records. The lawyer raises questions about any pending criminal charges.
"I wonder why the charge of forgery hasn't been charged yet," Petruzzi emphasizes, referring to the comparison between the medical records and the CEC form, which—according to the family—show discrepancies that amount to falsification.
The judicial investigation
The judiciary will now determine any criminal liability and verify the correctness of the procedures adopted before and after the transplant. The investigations will clarify not only the condition of the transplanted organ, but also the chain of internal communications and the information provided to the young patient's family.
This investigation is set to profoundly impact the clinical management of the case and transparency procedures within the healthcare facility.
