Naples – The preliminary investigation into the death of Carmine Puccinelli, a 14-year-old Neapolitan teenager who died in December 2023, has been concluded.

According to the Santa Maria Capua Vetere Public Prosecutor's Office, the boy's knee tumor was initially mistaken for a simple hematoma, causing a significant delay in identifying the oncological condition and initiating treatment. The health worker is charged with manslaughter.

According to the prosecution's approach, faced with a clinical picture that required immediate, specialized testing, essential diagnostic investigations were omitted or delayed. This delay, according to prosecutors, significantly impacted the progression of the illness and the final outcome.

The family's lawyers: "Concrete justice, not symbolic."

The law firm representing the victim's family announced the closure of the investigation. "This is not a symbolic battle, but a call for concrete justice," stated lawyers Michele Francesco Sorrentino, Pierlorenzo Catalano, and Filippo Castaldo. "When a tumor is mistaken for a hematoma and a teenager loses his life, the State has a duty to rigorously and transparently determine all liability."

The defense team hopes that a possible indictment can be ordered soon: "The start of the trial is the first real step towards the truth."

The issue of healthcare liability

The criminal proceedings, the lawyers emphasize, will not restore the young man's life, but they represent a crucial step in determining responsibility and affirming a principle: protecting health requires timely diagnoses, adequate clinical attention, and full compliance with professional standards.

The Puccinelli family will face the possible trial with the aim of clarifying whether the death could have been avoided, in what is considered one of the most painful cases of alleged medical malpractice in recent years.
