A formal complaint has been filed against lawyer Francesco Petruzzi, representing the family of little Domenico Caliendo, in relation to his appearance on the television program "Lo Stato delle Cose," which aired on March 16.
The report was addressed to the Council of the Naples Bar Association, RAI, the Italian Data Protection Authority, the Communications Regulatory Authority, and the Naples Public Prosecutor's Office, which was asked to assess any potential criminal implications.
The health issue at the center of the debate
During the episode, the case of little Caliendo was addressed, who underwent a heart transplant at the Monaldi Hospital, a procedure performed by cardiac surgeon Guido Oppido.
During the broadcast, medical documents were shown with the aim, according to the complaint, of supporting the thesis that the doctor had "made false statements" or was "clearly guilty," before any verification in the trial and in the absence of a technical-scientific cross-examination.
Doubts about the provenance of the documents
According to the person who filed the complaint, there is a "well-founded suspicion" that the documentation broadcast on TV reached the editorial staff—or host Massimo Giletti—via the family's lawyer.
A circumstance which, if confirmed, could constitute violations of both the Forensic Code of Ethics and criminal law.
The hypotheses of violation
The document alleges that attorney Petruzzi may have violated four articles of the Code of Ethics for Lawyers. Criminal charges include aggravated defamation, arbitrary publication of criminal proceedings, and disclosure of investigative secrecy.
The lawyer's reply
When questioned, lawyer Petruzzi rejected the accusations, specifying that during the broadcast the host had clarified the independent provenance of the documents.
“Journalist Massimo Giletti,” he declared, “specified that he acquired the material through his own sources, also emphasizing that I would be surprised.”
The lawyer must now provide his counterarguments within 20 days. The Bar Association will decide whether to initiate disciplinary proceedings, while the Prosecutor's Office will examine the criminal aspects highlighted in the complaint.
