Naples – Twelve healthcare workers will be tried in connection with the death of a six-day-old baby, which occurred on December 10, 2024, in the neonatal intensive care unit at the Monaldi Hospital. The decision was made by preliminary hearing judge Rosaria Maria Aufieri, at the request of the Naples prosecutor's office.

The prosecution accuses the professionals, employed in various capacities in the Neonatology department, of responsibility for the clinical management of the young patient, alleging conduct that did not conform to the expected standards.

The Prosecutor's Hypotheses

According to the investigators' reconstruction, coordinated by Deputy Prosecutor Manuela Persico, the death was attributed to alleged critical issues in the management of a central venous catheter used to feed the newborn, who was born underweight.

In particular, it is hypothesized that inadequate monitoring of the device may have caused cardiac damage, resulting in fluid leakage and severe cardiorespiratory failure that was fatal.
The complaints refer, in general terms, to possible profiles of incompetence, imprudence and negligence, as well as alleged violations of guidelines and good clinical practices.

However, this case concerns exclusively the area of ​​neonatology and presents a different picture from the recent case of little Domenico Caliendo.

The position of the family

The newborn's parents are being represented by a legal team in both the criminal and civil proceedings. Their lawyers welcomed the preliminary hearing judge's decision, emphasizing that the indictment represents "a significant first step toward establishing the facts and any liability."

The trial is scheduled to begin on July 13th. It will be during that time that the investigative findings and the positions of the twelve defendants will be examined in detail.
