The Guardia di Finanza and Carabinieri served the order, which also imposes a ban on external communications for the mayor, who is under investigation for serious charges of extortion. The case stems from an investigation by the Lagonegro Public Prosecutor's Office that alleges unscrupulous misuse of public power. According to investigators' reconstruction, Fortunato allegedly interfered in a private real estate transaction using coercive methods. The Prosecutor's Office's statement is explicit in describing the mayor's conduct, which "forced a private individual, owner of a business in the municipality, to hand over the sum of €10.000 in two separate installments." An extortion, in fact, carried out in the shadow of the town hall, to which the victim would have succumbed only "out of fear of the prejudicial consequences to which she would otherwise have been exposed."

The picture painted by investigators from the Sapri branch and the Judicial Police Department reveals a climate of subjugation that transcended the individual incident. Investigators openly speak of "a system of managing public affairs geared toward the pursuit of private interests, in which the mayor systematically interfered in the operations of the municipal technical office." This alleged hegemony over public offices was allegedly the lever used to bend the will of local citizens and merchants to his own personal ends.

The arrest stems from a complex legal battle between the prosecution and the defense. After the preliminary investigations judge initially rejected the precautionary measure, the Court of Review upheld the prosecutor's appeal in April of last year. The defense attempted to appeal to the Supreme Court of Cassation, obtaining an annulment with a postponement to October 2025, but the Court of Liberty of Potenza reaffirmed the house arrest order last January. The final word came on April 29, when the Supreme Court rejected the final appeal filed by Fortunato's lawyers, definitively establishing the need for the restrictive measure, which was recently implemented.
