Despite the recent notification of the eviction order, the legal battle over the fate of the "Castello delle Cerimonie" (the well-known "La Sonrisa" accommodation facility in Sant'Antonio Abate) is far from over. The Polese family's defense team has launched a new and complex legal counteroffensive in an attempt to prevent the closure and definitive confiscation of the properties.
The defense team—composed of attorney Dario Vannetiello for Concetta “Donna Imma” Polese and attorneys Veronica Paturzo and Andrea Castaldo for Agostino Polese—is pursuing parallel proceedings on two different judicial fronts: the Court of Cassation and the Rome Court of Appeal.
The appointment at the Supreme Court in July
The first crucial turning point is expected on July 9th. On that date, the Supreme Court will rule on the appeals filed by the defense against the inadmissibility of an initial request for review. According to the lawyers, in light of new information that emerged after the original trial, the crime of unauthorized development should be deemed nonexistent. The defense's argument is based on the alleged failure to verify, during the trial, the actual urban and settlement impact generated by the works carried out within the structure.
The new instance in Rome: the statute of limitations
In parallel, attorney Vannetiello has recently filed a further, complex request for review with the Rome Court of Appeal. The aim is to overturn the ruling issued in November 2016 by the Torre Annunziata Court (subsequently upheld in subsequent proceedings), which found the development to be unlawful and ordered the confiscation of all the buildings in the complex, including private residences.
This new motion is based on strictly procedural assumptions. By presenting eight new pieces of evidence—including previous criminal proceedings, expert reports, tax documentation, and photographs—the defense aims to demonstrate that the alleged crime, even if deemed to have occurred, had in fact already expired under the statute of limitations before the original trial began. If accepted, this interpretation would nullify the confiscation, restoring full ownership to the Polese family.
The future of the facility and the protection of workers
The outcome of these legal actions is awaited with great apprehension not only by the owners, but also by the local community. The facility, renowned nationally and internationally for hosting successful television programs, historic events (such as the Neapolitan Song Festival), and illustrious figures over the course of half a century, represents a major employment hub. Indeed, approximately one hundred employees currently have their future jobs tied to the courts' decisions.
The defense strategy, structured on multiple levels, aims to replicate favorable outcomes achieved in other complex legal proceedings. In this regard, the defense looks forward to future developments with confidence, recalling recent rulings in which successful appeals led to the revocation of seizures and the return of well-known assets to their rightful owners, at the end of lengthy legal proceedings. The final decision now rests with the magistrates.
Deepening
The legal battle over the fate of the "Castello delle Cerimonie" (Castle of Ceremonies) doesn't stop with the eviction order. The Polese family is now aiming for a review of the case before the Supreme Court, with a crucial hearing scheduled for July 9th. Behind this legal battle lies not just a legal issue, but a crucial issue for the economy and social life of Sant'Antonio Abate. The permanent closure of La Sonrisa risks leaving dozens of employees unemployed and jeopardizing a network of suppliers and related businesses, with an impact that extends beyond the walls of the famous structure. A comparison with other similar cases shows how judicial decisions in the tourism sector can profoundly impact local communities, fueling uncertainty and concern. The stakes are high, and the Polese case remains a test for the future of the area.
